FavMekan Terms of Service

1. Parties and Definitions

These Terms of Service ("Agreement") govern the legal relationship between you ("User") using the FavMekan mobile application ("Application") and FavMekan ("Company", "We", "Platform").

Definitions:

  • Application: The FavMekan mobile application available on iOS and Android operating systems
  • User: Any natural person who downloads, installs, or uses the Application
  • Content: Favorite lists, collections, comments, video shares, and other user contributions created by Users
  • Business Owner: A natural or legal person who claims and is approved as the owner of a venue on the Platform
  • PRO Subscription: A monthly auto-renewing premium membership
  • Credits: Digital units purchased by Business Owners to use platform features

By downloading, installing, or using the Application, you acknowledge that you have read, understood, and accepted all terms of this Agreement.

2. Service Description

FavMekan is a mobile platform that enables users to:

  • Map: Discover independent (indie) restaurants on a map and view their details
  • Explore: Search for restaurants and follow social activity feeds
  • Social: Follow other users, create favorite lists and collections
  • AI Analysis: Analyze videos with artificial intelligence for venue identification
  • Business Management: Allow business owners to manage their venues, make announcements, and create campaigns

3. Account and Registration

3.1 Registration Methods

You must create an account using one of the following methods to use the Application:

  • Sign in with Google
  • Sign in with Apple
  • Email and password registration

3.2 Age Restriction

You must be at least 13 years old to use the Application. Users under 18 may register with the consent of a parent or guardian.

3.3 Username

  • Your username must be unique and may only contain lowercase letters, numbers, and underscores (_).
  • Inappropriate, misleading, or rights-infringing usernames are not permitted.
  • The Platform reserves the right to change inappropriate usernames.

3.4 Account Security

  • You are responsible for the confidentiality of your account information.
  • You are responsible for all activities that occur under your account.
  • If you notice unauthorized access, you must immediately notify destek@favmekan.app.

4. User Obligations

When using the Application, you agree and undertake to:

  • Comply with the laws of the Republic of Türkiye and international law
  • Respect the personal rights of other users
  • Not share misleading, insulting, threatening, or harassing content
  • Not damage the technical infrastructure of the Application
  • Not use automated data collection tools (bots, scrapers, crawlers, etc.)
  • Not access other users' accounts without authorization
  • Not send spam, chain messages, or unsolicited commercial communications
  • Not share false or misleading business information

Violation of these obligations may result in suspension or permanent closure of your account.

5. User-Generated Content (UGC)

5.1 Content Sharing

  • You are personally responsible for all content you share (favorites, collections, video shares, etc.).
  • It is your obligation to ensure that your content does not infringe the intellectual property rights of third parties.

5.2 Content License

  • You grant us a worldwide, non-exclusive, royalty-free, sublicensable right to use, display, and distribute content you upload to the Platform.
  • This license terminates within a reasonable period after you delete your content from the platform.
  • Copies remaining in technical backups after deletion will be removed within 90 days.

5.3 Content Moderation and Reporting

  • You have the right to report content that violates community guidelines using the in-app reporting feature.
  • The Platform reserves the right to remove inappropriate content without prior notice.
  • Abuse of the reporting feature is subject to sanctions.

6. Subscription and Payment

6.1 PRO Subscription (User)

  • PRO subscription is a monthly auto-renewing subscription through the Apple App Store / Google Play Store.
  • Current pricing is displayed in the app store.
  • A 7-day free trial period may be offered.
  • Cancellation is done through the relevant store's Settings > Subscriptions section.
  • Cancelled subscriptions remain active until the end of the current period.

6.2 Business PRO Subscription

  • A monthly auto-renewing premium subscription exclusive to business owners.
  • Includes unlimited announcements, bonus credits, and additional features.

6.3 Business Credits

  • Credits are digital units purchased by business owners to use platform features such as announcements, push notifications, and featured listings.
  • Purchased through in-app purchases via the Apple App Store / Google Play Store.
  • Purchased credits are non-refundable and non-transferable.

6.4 Refund Policy

  • Subscription refunds are subject to Apple/Google's refund policy.
  • Refund requests should be made directly to the relevant store.
  • Credit packages are non-refundable.

7. AI Video Analysis

  • You can analyze shared videos with artificial intelligence for venue identification.
  • AI results are estimates and no guarantee of 100% accuracy is given.
  • You can reject the analysis in case of incorrect identification.
  • Analyzed video content is processed solely for venue identification purposes and is not permanently stored.
  • The Platform cannot be held responsible for any damages arising from AI analysis results.

8. Intellectual Property

  • The FavMekan brand, logo, design, and software are protected under the intellectual property laws of the Republic of Türkiye.
  • Unauthorized copying, distributing, modifying, or creating derivative works from application content is prohibited.
  • Users may not attempt to reverse engineer the application code.

9. Limitation of Liability

  • The Application is provided "as is"; no guarantee is given that the service will be uninterrupted or error-free.
  • Restaurant information displayed on the Platform (menu, prices, working hours) may not be current.
  • Rating data obtained from Google Maps is Google's responsibility.
  • We are not liable for indirect damages arising from outages, data loss, or technical issues.
  • The Platform is not a party to disputes arising from user interactions.

10. Account Deletion

  • You can permanently delete your account at any time from within the app (Settings > Delete Account).
  • Account deletion is irreversible.
  • Upon deletion, all your personal data, favorites, follow lists, and content will be permanently deleted or anonymized.
  • Data subject to legal retention obligations (tax documents, etc.) will be deleted after the relevant period.

11. Changes

  • We reserve the right to update this Agreement.
  • Significant changes will be announced at least 15 days in advance via in-app notification.
  • If you do not accept the updated terms, you should stop using the Application.
  • Continuing to use the Application after notification means you accept the updated terms.

12. Dispute Resolution

  • This Agreement is subject to the laws of the Republic of Türkiye.
  • Amicable resolution shall be sought first.
  • If no resolution is reached, Istanbul Courts and Enforcement Offices shall have jurisdiction.
